These terms of use constitute a binding agreement (“Agreement”) between Erin Austin Law PLLC (“EAL”) and any person accessing this website (“Site User” or “you”), to ensure a clear understanding of the relationship arising from your use of the Site and any services EAL may offer through it.

This Agreement sets forth both the terms and conditions governing your use of the Site. You agree to abide by all of the terms of this Agreement as a condition of your continuing use of, or access to, the Site.

1. Website

The Website and all material included on it is proprietary to EAL, and is protected by the copyright laws of the United States and various international treaties governing intellectual property. Your access to the Website is by license, which is grated solely for your non-exclusive personal use, subject to the terms, conditions and limitations of this Agreement. EAL may, as its sole discretion, discontinue providing access to the Site at any time and for any reason, with or without notice.

2.  Site Not Intended as Legal Advice; No Attorney-Client Relationship Formed by Use

The information and content contained on the Website is general in nature, and is provided for information purposes only. It is not to be relied upon, nor construed as, providing legal advice or legal opinions about any specific issue or factual circumstance, and EAL assumes no liability or responsibility for any errors or omissions in the content of this Website. EAL does not represent or warrant that the contents of the Site are complete, accurate or up to date.

Neither your accessing the Site, nor your receiving information from it, creates an attorney-client relationship between EAL and you. You must consult specifically with an attorney qualified to practice in your state in the event that you seek legal advice, or before relying upon any information or content contained on the Site.

Transmission of information between EAL and you is not intended to, and will not, form an attorney-client relationship between EAL and you. An attorney-client relationship will not be created unless and until an authorized representative of EAL expressly agrees in a written engagement letter signed by EAL and you that EAL will undertake an attorney-client relationship with you (or as otherwise provided by law or regulation).

You should not transmit any confidential or sensitive information to EAL unless and until you have received written acceptance from EAL to undertake the legal services you may request. Until such acceptance, no formal attorney-client relationship has been established between EAL and you, it being understood and agreed by Site User that EAL does not agree to accept and/or maintain the confidentiality of any unsolicited information sent to EAL unless a formal attorney-client relationship exists.

Without limiting the generality of the foregoing, please note that an attorney-client relationship will not commence until relevant information concerning potential conflicts of interest are evaluated (it being understood and agreed that even in the absence of any conflict of interest, EAL may decide not to enter into an attorney-client relationship with you).

3. Security and Privacy

EAL will not monitor, edit, or disclose any personal information about you, including your name, address, email, phone number, or your use of the Website, without your prior consent, unless EAL has a good faith belief that such action is necessary to: (i) comply with the legal process or legal requirements of any government agent or authority; (ii) protect and defend the rights or property of EAL; (iii) enforce this Agreement; (iv) protect the interests of users or the Website other than You or any other person; or (v) operate or conduct maintenance and repair of EAL’s services or equipment, including the Website.

All materials included on this Website including (but not limited to) text, graphics, images, logos and other materials, and all related intellectual property (trademarks, service marks, trade dress and copyrights), are owned by or are displayed by EAL with permission of its owners, or as permitted by applicable law. EAL authorizes you to view, copy, download, and print documents and other materials contained on this website, subject to the following conditions: (1) the documents and other materials may be used solely for personal, noncommercial, educational, and informational purposes; (2) the documents may not be modified; and (3) the following copyright notice and permission notice must appear in each document:

6. Modifications to Agreement

From time to time, EAL may change, modify, add or remove any portion of this Agreement, in whole or in part, in EAL’s sole discretion, to comply with laws and regulations or other reasons. Any and all such modifications to this Agreement will be posted on this Website. Your continued use of this Website after any modifications have been made shall be deemed acceptance of the terms and conditions as so modified.

7. Prohibited Uses

The following will be deemed unacceptable uses of this Website, and you hereby agree to not engage in these: (a) transmit material that may be defamatory, false, harassing, vulgar, threatening, malicious, obscene, or pornographic to a reasonable person; (b) transmit unsolicited commercial e-mail or “chain letter” type communications; (c) transmit unsolicited messages, chain letters, or unsolicited commercial email; (d) transmit any materials (whether written, photographic, graphic, software, or otherwise) that actually or potentially infringes on copyright, trademark, patent, trade secret, privacy, or other rights of any person or entity; (e) transmit viruses, malicious code, or similar disruptive programs; or (f) engage in any other activity deemed by EAL to be inconsistent with law or in conflict with this Agreement.

As a convenience, some portions of this Website may contain links to other websites, which are not under the control of EAL, nor maintained by EAL. Therefore, EAL is not responsible for the contents of any such linked website, and disclaims any liability for the content or your usage thereof. No endorsement, approval, nor sponsorship by EAL of any linked site is undertaken no implied, and your usage of any linked site is made entirely at your own risk.
